CDC Director Nominee Deadline Looms as Vacancy Exceeds 210 Days

The White House faces a rapidly approaching deadline to nominate a permanent director for the Centers for Disease Control and Prevention (CDC), yet remains publicly silent on its plans. The federally mandated limit of 210 days for temporary leadership at an executive branch agency is drawing near, raising questions about potential disruptions to public health leadership.

The current situation stems from a series of temporary appointments following the firing of Susan Monarez, PhD, as CDC director on August 27, 2025. As reported by Healio, Jim O’Neill initially served as acting director until February 13, 2026, when NIH Director Jay Bhattacharya, MD, PhD, was selected to temporarily lead the agency.

The Vacancies Reform Act dictates that an executive branch position cannot be temporarily filled for more than 210 days from the date the vacancy occurs. According to Lawrence O. Gostin, JD, professor and founding director of the O’Neill Institute for National and Global Health Law at Georgetown University, this clock continues running regardless of how many individuals serve in an acting capacity. “This clock pauses while a nominee is pending in the Senate, and a novel 210-day period begins if a nominee is rejected, withdrawn or returned,” Gostin explained.

With O’Neill and Bhattacharya’s combined tenure nearing the 210-day mark – calculated to be March 25, 2026 – the White House has approximately one week to put forward a nominee. Multiple requests to the White House for comment on its plans have gone unanswered.

Implications of Exceeding the Deadline

Should the 210-day limit be surpassed without a nominee, the Comptroller General is required to report the situation to relevant congressional committees. This could prompt increased scrutiny from Congress and pressure on the administration to nominate a permanent director.
