Orthopedic Surgeons Increasingly Opting Out of Medicare, Data Shows

Patterns are emerging in Medicare opt-out rates among orthopedic surgeons, with a tiny but notable percentage choosing to forgo Medicare reimbursements. While overall opt-out rates remain relatively low at 1.15%, modern data presented at the American Academy of Orthopaedic Surgeons (AAOS) Annual Meeting reveals distinct trends based on surgical subspecialty, geographic location, and practice type. This shift is likely driven by a combination of administrative burdens and declining, inflation-adjusted reimbursement rates, impacting physician practices across the country.

Catherine B. Hurley, MS, a second-year medical student at the Florida State University College of Medicine and a member of the research team in the Spine Lab at Brown University’s department of orthopedics, presented the findings in New Orleans this week. The research utilized data from the Centers for Medicare & Medicaid Services (CMS) Opt-Out Affidavit database to analyze factors associated with orthopedic surgeons’ decisions to not participate in Medicare.

Subspecialty and Geographic Disparities

The analysis identified significant differences in opt-out rates among orthopedic subspecialties. Spine surgery and sports medicine demonstrated the highest proportions of surgeons choosing to opt out of Medicare. This suggests that these specialties may be particularly sensitive to the financial pressures and administrative complexities associated with Medicare participation.

Geographic location too played a role, with surgeons practicing in high-cost states – including New York, California, and Florida – exhibiting higher opt-out rates. This correlation likely reflects the increased overhead costs and financial challenges faced by practices in these areas.

Practice Type and Opt-Out Decisions

The study also highlighted a clear association between practice type and Medicare opt-out rates. A substantial 74.5% of private practices opted out of Medicare, compared to only 16.5% of academic centers and 9% of public centers (such as municipal hospitals, government-run hospitals, or Veterans Affairs centers). This disparity suggests that the financial and administrative burdens of Medicare participation may disproportionately affect smaller, independent practices.

The reasons behind these trends are complex. Declining reimbursement rates, coupled with increasing administrative demands, can create significant financial strain for orthopedic practices. Opting out of Medicare allows surgeons to potentially avoid these challenges, but it also means they are responsible for collecting payment directly from patients.

Understanding the “Why” Behind Opt-Outs

Hurley emphasized the need for further research to understand the motivations driving these decisions. “The next step would be to reach out to those surgeons and see why are they opting out? What steps did they take to reach the decision that they seek to opt out of Medicare and see what each of those thought processes seem like,” Hurley told Healio.

Understanding the specific factors influencing surgeons’ choices is crucial for developing effective solutions to address the challenges facing orthopedic practices.

Looking Ahead: Policy Implications and Future Research

Hurley also suggested investigating the impact of policy changes on opt-out rates. Analyzing trends in opt-out rates during periods of significant Medicare reimbursement adjustments could provide valuable insights into the factors driving these decisions. For example, the research team noted high opt-out rates in 2016 and 2023 and plans to investigate what policy changes occurred during those years.

The increasing trend of orthopedic surgeons opting out of Medicare raises important questions about access to care and the sustainability of orthopedic practices. Further research and policy discussions are needed to ensure that patients continue to have access to high-quality orthopedic care.
