Reports are emerging of individuals avoiding medical care, even in emergencies, for fear of potential detention. This shift is raising concerns about public health and ethical obligations within the medical community.

The policy change, enacted in early 2024, removed previous guidance that had generally shielded locations like hospitals, schools, and churches from immigration enforcement activities. While agents were never explicitly prohibited from operating in these areas, the prior policy prioritized avoiding enforcement actions that could disrupt essential services or instill fear within communities. The Department of Homeland Security (DHS) stated the revised policy “empowers the brave men and women in CBP and ICE to enforce our immigration laws and catch criminal aliens.”

Impact on Patient Care: Stories from the Field

Recent incidents illustrate the tangible consequences of the policy shift. In Portland, Oregon, a family seeking urgent care for their 7-year-traditional daughter was detained by Immigration and Customs Enforcement (ICE) agents in the hospital parking lot. According to reports, the parents, who are seeking asylum, and their daughter were taken to a detention center despite the child’s immediate medical needs. The mother, Darianny Liseth Gonzalez De Crespo, reportedly pleaded with agents to allow her to seek care for her daughter, Diana Crespo, who was experiencing a nosebleed that wouldn’t stop. The family’s lawyer, Natalie Lerner, confirmed they had been following appropriate steps in their asylum claim.

Similar concerns have surfaced in other states. In Minnesota, a physician, Dr. Roli Dwivedi, described a situation where a mother and son were separated in a clinic parking lot while attempting to fill a prescription for seizure medication. NPR reported that Dr. Dwivedi too shared accounts of a pregnant mother who delayed seeking prenatal care due to fear of detention, ultimately going into labor at home alone.

A Reversal of Long-Standing Precedent

Anna Cabot, immigration clinic director at the University of Houston, explains that the policy change represents a significant departure from decades of established practice. “It’s always been a policy of the Department of Homeland Security to be like, look, we’re not going to do this because we regard these places – being in these places as kind of fundamental to human existence and important,” she stated. While agents are still restricted from conducting enforcement actions within private areas like exam rooms, the revised policy allows for arrests in public spaces adjacent to sensitive locations, such as parking lots and waiting rooms.

Limited Options for Healthcare Facilities

Healthcare facilities are grappling with limited options to protect their patients. Cabot suggests that hospitals and clinics could enhance security measures and restrict access to waiting rooms, but acknowledges these are imperfect solutions. The American Hospital Association has not yet issued a public statement on the matter, but some individual facilities are taking proactive steps. St. John’s Community Health in Los Angeles, for example, has increased security and developed plans to move patients from waiting rooms into exam rooms if ICE agents appear. The organization also dispatched doctors and nurses to patients’ homes during recent ICE raids, responding to cases like a 6-year-old experiencing severe asthma attacks due to fear of seeking medical attention.

The Ethical Dilemma for Medical Professionals

Jim Mangia, CEO of St. John’s Community Health, emphasizes the ethical obligations of healthcare providers to prioritize patient care regardless of immigration status. “I’m disappointed in the response of some in the health care community. And I also understand it’s a incredibly intimidating environment. If we’re going to defeat the forces of darkness in this country, we have to fight,” he said. The situation presents a complex dilemma for medical staff, who must balance their commitment to patient well-being with the potential for legal repercussions or disruption of their facilities.

Understanding the Broader Context of Immigration Enforcement

The policy changes are occurring alongside a broader intensification of immigration enforcement under the Trump administration. The White House reports that illegal crossings declined in 2025 as resources were redirected to enforcement, and that over 2.5 million individuals have left the U.S. Since President Trump returned to office, either through deportation or self-deportation. The One Big Beautiful Bill Act (OBBBA), passed in July 2025, allocates nearly $170 billion to enforcement over the next four years, further fueling these efforts.

What Comes Next: Monitoring and Advocacy

The long-term impact of the policy change remains to be seen. Healthcare organizations and advocacy groups are closely monitoring the situation and collecting data on the number of patients affected. Further research is needed to fully understand the extent to which fear of immigration enforcement is deterring individuals from seeking necessary medical care. Ongoing legal challenges to the policy are also expected. The DHS has not responded to requests for comment regarding the effect of conducting immigration enforcement in sensitive areas, but continued scrutiny and advocacy from the medical community and immigrant rights organizations will be crucial in addressing this emerging public health concern.
