Nintendo of America is taking legal action against the U.S. Government, challenging the validity of tariffs imposed during the Trump administration. The lawsuit, filed in the U.S. Court of International Trade, centers on tariffs enacted through executive orders and the International Emergency Economic Powers Act (IEEPA). This move follows a February Supreme Court ruling that deemed these tariffs unlawful, though the court did not specify a process for refunding the collected fees. Nintendo is seeking “a prompt refund, with interest” for the tariffs it has already paid, a sum that likely amounts to millions of dollars.

The IEEPA and Executive Orders: A Shift in Trade Policy

While intended for genuine crises, the Trump administration’s application of IEEPA to implement tariffs based on trade policy concerns stretched the law’s original intent.
